Case Held: Now, it is trite that once a person is made a party to a Suit, he is entitled to be heard on every material, issue or aspect of that case before a decision is made on it. It is therefore not open to the trial court to determine pre-emptorily without giving the 2nd -5th Appellants a hearing or an opportunity of being heard, that they are not affected with the application for Interlocutory Injunction. It is for the 2nd -5th Appellants To say so. And it is in order to achieve the imperative of hearing all parties to the Suit that service of the Processes in the Suit on the parties, as well as a Hearing Notice where required is fundamental.
