Denca Services Limited Vs. Cross Marine Services Limited (2002) FWLR (Pt. 87) 490

Case Applicant: Ogochukwu Mbamalu Esq
Case Respondent: Chris O. Okoro Esq
Case Issue: Where a container No. Ikau450540 Is already off-loaded from Mv Kukawa (a shipping vessel) and taken out of the Sea and the federal Port and is being used or detained or lost by the appellant, whether a claim for the said detention, loss of use, falls within the jurisdiction of the Federal High Court.
Case Held: I have no hesitation in accepting the submission of the learned counsel for the appellant that the Plaintiff’s Claim at the lower court did not come under the admiralty jurisdiction of the Federal High Court. It is a simple contract of bailment. The trial court being a federal high court was therefore wrong In assuming jurisdiction and adjudicating in the matter
